WHAT IS THE ARD PROGRAM?

The ARD Program is probation without a verdict. It is not a "class." It is not an "online program." It can be 12 to 18 months of probation. It can be very expensive.​

Each county in Pennsylvania has a different procedure for requesting and completing the ARD. Therefore, it is important that you work with a law firm, like us, who knows the application process in each county.

WHAT IF I HAVE A CDL?

Any outcome other than an acquittal or dismissal of your DUI charges will result in a disqualification of your CDL privileges. Attorney Morgan literally grew up in the cab of a tractor trailer. As the son of an Owner-Operator Truck Driver, Dean understands the importance of a CDL.  ​​

We work to protect your CDL. If you have a CDL, your CDL will be disqualified for 12 months. I understand the importance of a CDL to your employment. We will work with your employer to explain the process and help them to help you maintain your employment.

SHOULD I FIGHT MY CHARGES?

ARD is not the right choice for everyone. It is the lesser of two evils. Only after a full evaluation of your case can we determine if ARD is the right choice for you. Although we cannot guarantee any particular outcome, we have had success with getting DUI charges completely dismissed for first time offenses. DO I NEED AN ATTORNEY
FOR ARD?

ARE THERE ANY
NEGATIVE ASPECTS OF ARD?

You should be aware of the following facts:
• Your license will be suspended for 30, 60, or 90 days.
• ARD does NOT wipe the slate clean
• ARD remains on your PennDOT Driving Record for 10 years.
• ARD counts as a prior conviction if you are arrested for DUI again within the next 10 years.
• If you have a CDL, it will be disqualified for 12 months.
• You may have to perform up to 100 hours of community service.
• ARD probation may restrict your right to possess firearms.
• The District Attorney has complete discretion to admit and remove you from the program.

My job, when representing an individual applying for ARD, is to review the facts and circumstances of the case, remaining vigilant to determine whether there is a possibility that the charges may be dismissed due to an evidentiary issue or whether there is a strong possibility of acquittal. If either of these situations arises, I will make a recommendation to you as to how we should proceed.

HOW MUCH DOES ARD COST?

The government requires a NON-REFUNDABLE fee between $1500.00 and $3000.00. These costs vary by county. ​
