WHAT IS THE
ARD PROGRAM
The ARD Program is program for first-time offenders.  It is probation without a verdict. It is not a "class." It is not an "online program." It can be 6 to 18 months of probation.  If you successfully complete the program, your charges are dismissed and your criminal record will be expunged.   However, it does not "wipe the slate clean." Rather, it can best be described as the lesser of two evils. 

Each county in Pennsylvania has a different procedure for requesting and completing the ARD. Therefore, it is important that you work with a law firm, like ours, who are experts in the application process in each county.

DO I NEED
AN ATTORNEY

AM I ELIGIBLE 
FOR  ARD 
By law, you are not eligible for ARD if you: 
  • Two or more prior DUI in lifetime
  • Any DUI within the last 10 years (unless it was for 3802(a)(2)
  • Child under 14 in the vehicle

However, each county has thier own rules for admission. Some counties preclude admission for some, or all of the following reasons:
  • Chemical Test Refusal
  • BAC above .24, .25, or .30
  • Opiates
  • Accidents involving injuries
  • Accidents involving property damage
  • Any prior DUI
  • Prior Criminal Record

Ultimately, the District Attorney has absolute discretion over who he/she will admit into the program.  Therefore, it is essential you have an attorney, like ours, that knows and understands all the rules and can effectively negotiate waivers where appropriate. 


WHAT ARE
THE NEGATIVES
You should be aware of the following facts:
• Your license will be suspended for 30, 60, or 90 days.
• ARD does NOT wipe the slate clean
• ARD remains on your PennDOT Driving Record for 10 years.
• ARD counts as a prior conviction if you are arrested for DUI again within the next 10 years.
• If you have a CDL, it will be disqualified for 12 months.
• You may have to perform up to 100 hours of community service.
• ARD probation may restrict your right to possess firearms.
• The District Attorney has complete discretion to admit and remove you from the program.

My job, when representing a person applying for ARD, is to review the facts and circumstances of the case, remaining vigilant to determine whether there is a possibility that the charges may be dismissed due to an evidentiary issue or ​whether there is a strong possibility of acquittal. If either of these situations arises, I will make a recommendation to you as to how we should proceed.​

ARD COST
Each county sets their own fees.  In most cases, the fee is between $1100 and $3000.  Because these fees are non-refundable, you will want to make sure that ARD is the right choice AND you will successfully complete the program.

WHAT IF I
HAVE A CDL
Any outcome other than an acquittal or dismissal of your DUI charges will result in a disqualification of your CDL privileges. Attorney Morgan literally grew up in the cab of a tractor trailer. As the son of an Owner-Operator Truck Driver, Dean understands the importance of a CDL.  ​​​​​​

We work to protect your CDL. If you have a CDL, your CDL will be disqualified for 12 months with ARD. I understand the importance of a CDL to your employment. We will work with your employer to explain the process and help them to help you maintain your employment.
